Maximum Liability
In no event shall our total aggregate liability exceed the amount you paid to Pinnacle for services during the six months preceding the claim, or one hundred euros, whichever is greater. This limitation applies regardless of the legal theory upon which the claim is based.
Essential Purpose
These limitations of liability are fundamental elements of the agreement between you and Pinnacle. Our services would not be provided without these limitations. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you.
Force Majeure
Pinnacle shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
In the event of such circumstances, our performance obligations shall be suspended for the duration of the force majeure event, and we will make reasonable efforts to resume performance as soon as practicable.
Dispute Resolution and Governing Law
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Jurisdiction
Any legal action or proceeding arising under these Terms and Conditions shall be brought exclusively in the courts located in Berlin, Germany. You hereby consent to the personal jurisdiction and venue of these courts.
